概要: Since 2008, the Osaka Restoration Party (Osaka Ishin no Kai) has been leading education reform in Osaka. On March 23, 2012, on the initiative of Osaka Ishin no Kai, two ordinances which provide for various contents concerning education and educational administration were adopted in the Osaka prefectural assembly. The two ordinances contain various problems in light of the current legal system. Especially, they seem to encroach on the basic principles of educational administration established during the postwar education reform. The basic principles are : (1) Autonomy in education, (2) Independency of educational administration from general administration, (3) Decentralization of educational administration, and (4) Popular control of educational administration. The aim of this paper is to analyze the two ordinances in light of above-mentioned basic principles of educational administration. First, it explains the characteristics of education reform in Osaka shown by the two ordinances. Second, it confirms the contents of the basic principles of educational administration and mutual relations between those basic principles. Third, it analyzes the legal problems of two ordinances in light of the basic principles of educational administration. On the basis of these analyses, it finally shows some countermeasures against the Osaka education reform. 続きを見る

概要: The aim of this paper is to analyze the education reform in the United Kingdom of Great Britain and Northern Ireland. Wales has continued the education reform independently since the 2000s. In 2004, Welsh Government determined to replace the national test by a new learning assessment system called the teacher assessment. The composition of this paper is as follows. First, it explains the Education Act 1944 which laid the foundations for the compulsory education. Second, it examines the neo-liberal education reform which has started in the 1980s. Third, it refers to the present situation of the education reform in Wales. On the basis of these analyses, it clarifies some problems of the education reform in Wales. 続きを見る

概要: In 2012, on the initiative of the Osaka Restoration Party (Osaka Ishin no Kai), the ordinances which provide for the various contents about education and educational administration were enacted in Osaka Prefecture. These ordinances seem to be against the Constitution of Japan, the Fundamental Law of Education (as revised in 2006), and the Law of the Local Educational Administration, and further, they are likely to encroach on the essential principles of the educational administration established in the postwar education reform. The aim of this paper is to analyze on these ordinances focusing on their legal problems. Chapter 1 of this paper gives an overview on the Osaka Educational Reform which seems to be based on the neo-liberalism. Chapter 2 analyzes the legal issues of these ordinances. Based on the above analysis, Chapter 3 is to address the issue of the relation between education and politics. 続きを見る
